Welcome to StayRunners. By accessing or using our website, mobile application, and services (collectively, the "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Platform.

2. Description of Service

StayRunners operates a 24/7 on-demand delivery platform that connects customers with independent delivery drivers ("Runners") for the delivery of alcohol, cannabis, vapes, cigarettes, gifts, and other permitted items. We facilitate these transactions but do not directly provide the delivery services.

Important: StayRunners acts as a technology platform connecting users with independent contractors. We are not a delivery service provider, retailer, or distributor of the products ordered through our Platform.

3. Eligibility and Account Registration

3.1 Age Requirements

You must be at least 18 years old (or 21+ for alcohol and cannabis orders) to use our Platform. By using our services, you represent and warrant that you meet these age requirements.

3.2 Account Registration

• You must provide accurate, current, and complete information during registration
• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activities that occur under your account
• You must notify us immediately of any unauthorized access to your account

4. Ordering and Delivery

4.1 Order Placement

• Orders are subject to availability and acceptance by Runners
• We reserve the right to refuse or cancel any order at our discretion
• Prices and availability are subject to change without notice
• You are responsible for providing accurate delivery information

4.2 Age Verification

For age-restricted products (alcohol, cannabis, tobacco), Runners will verify your age and identity upon delivery. You must present valid government-issued photo identification. Orders will not be completed without proper verification.

4.3 Delivery

• Estimated delivery times are approximate and not guaranteed
• You must be present to receive age-restricted deliveries
• Runners have the right to refuse delivery if age verification fails
• Additional fees may apply for certain delivery locations or times

5. Payment and Fees

• Payment is required at the time of order or upon delivery
• We accept cash, credit/debit cards, and cryptocurrency payments
• Prices include applicable taxes and fees unless otherwise stated
• Tips are optional but appreciated and go 100% to Runners
• Refunds are handled on a case-by-case basis

6. Prohibited Uses

You agree NOT to:

• Use the Platform if you are under the legal age for the products ordered
• Provide false information or impersonate another person
• Violate any applicable local, state, national, or international law
• Order prohibited or illegal items
• Harass, abuse, or harm Runners or other users
• Attempt to circumvent age verification or other security measures
• Use the Platform for any commercial purpose without authorization
• Interfere with or disrupt the Platform or servers

7. Runner Terms

7.1 Independent Contractor Status

Runners are independent contractors, not employees of StayRunners. Runners are responsible for their own taxes, insurance, and compliance with local laws.

7.2 Runner Requirements

• Must be at least 21 years old
• Must have valid identification and necessary licenses/permits
• Must comply with all applicable laws and regulations
• Must complete age verification training
• Must maintain appropriate insurance coverage

8. Intellectual Property

All content on the Platform, including text, graphics, logos, images, and software, is the property of StayRunners or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not use, reproduce, or distribute any content without our written permission.

9. Disclaimers and Limitations of Liability

9.1 Platform Provided "As Is"

The Platform is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Platform will be uninterrupted, error-free, or secure.

9.2 Limitation of Liability

To the maximum extent permitted by law, StayRunners shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Platform. Our total liability shall not exceed the amount you paid for the specific order giving rise to the claim.

9.3 Third-Party Products

We are not responsible for the quality, safety, or legality of products ordered through the Platform. Disputes regarding products should be directed to the retailer or supplier.

10. Indemnification

You agree to indemnify, defend, and hold harmless StayRunners and its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of your use of the Platform, violation of these Terms, or violation of any rights of another party.

11. Termination

We reserve the right to suspend or terminate your access to the Platform at any time, with or without cause or notice, for any reason, including violation of these Terms. Upon termination, all provisions of these Terms that by their nature should survive shall survive.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which StayRunners operates, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on the Platform and updating the "Last Updated" date. Your continued use of the Platform after changes constitutes acceptance of the modified Terms.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
